VAT on demolition and reconstruction: permanent regime from 1 July 2025
From 1 July 2025, a definitive, permanent regime applies to the reduced VAT rate of 6% for the demolition and reconstruction of dwellings, published in the Belgian Official Gazette on 29 July 2025 (Programme Act). This regime replaces the previous temporary and transitional measures and offers greater legal certainty for building owners, developers and buyers. ⚠ The VAT regime for demolition and reconstruction contains several scenarios and conditions. Consult Reius and your tax advisor for the specific application to your project.
For whom?
Real estate developers and project promoters in residential, commercial or mixed-use projects, project financiers and investors, landowners seeking to develop their land, and contractors and architects involved in major construction projects.
Frequently asked questions
How should I best structure my project: privately or through a company?
This depends on the scale of the project, the planned exit strategy, the tax context and other factors. Reius analyses your situation and advises on the most suitable structure in cooperation with your tax advisor.
Can my project as a developer qualify for the 6% VAT rate on sale?
Under the permanent regime in force in principle from 1 July 2025, this is possible, provided all legal conditions are met. Consult Reius and your tax advisor for the specific application to your project.
How do I deal with objections to my environmental permit?
Objections may be submitted during the public inquiry or after the permit has been issued. Reius advises you on the strategy and represents you, if necessary, before the competent authorities.
